Bricks (“Software”) is a WordPress theme that lets you visually create and manage WordPress websites. It is offered by Codeer Limited (“Company”). The Software is distributed through bricksbuilder.io (“Website”).

The following terms of service (“Terms”) are a legally binding agreement (“Agreement”) with the Company and you (“User”). By accessing the Website, purchasing/installing/downloading/using the Software you acknowledge that you have read, understood, and agree to the Website’s privacy policy and the terms outlined below. If you disagree with those terms or the privacy policy, please stop using this Website and Software immediately. You must also be at least 18 years of age to use the Software.

These Terms are subject to change at any time without prior notice. It is your responsibility to review the Terms regularly.

Access to the Website, purchasing Licenses, downloading the Software, or updating your account through the Website is provided “as is” without any warranty about availability and quality.

By using the Website and Software, you consent that the Company collects, uses, and discloses personally identifiable information and any non-personally identifiable information, as outlined in our privacy policy.

Registration

When purchasing a License of the Software you agree to submit your payment details, such as PayPal or credit card information, to our third-party payment processor (Paddle.com). The Company itself does not store any of your payment details.

Software License

Bricks Licenses are non-exclusive, non-sublicensable, and non-transferable.

By purchasing a License, you are granted a right to use the Software to create and maintain your own and your client’s WordPress websites. A Client is defined as a person or corporate entity that has issued you with the task of creating its website with our Software.

Reselling, transferring, or providing access to your account or license key to any other third party is strictly prohibited.

Every WordPress installation/site URL requires an active Bricks license. This means each subsite of a multisite must be activated individually and counts against your license limit.

Software Updates

You are eligible for Software updates for the period of the Plan you have purchased. Updates are only provided for active licenses. Canceling your subscription or a repeated unsuccessful attempt to collect your payment deems your subscription inactive/canceled.

You can continue using Bricks after your effective cancellation date has been reached if you have made at least one successful non-refunded yearly subscription payment. Lifetime licenses receive updates and support as long as Bricks is in active development.

When downloading a Software update through the WordPress dashboard, a request to the Company server is performed, which submits some user data, such as your License key and the requesting domain name, IP address, etc., to validate and authenticate your request.

Updates are provided on a non-fixed but regular basis as long as the Software is available through the Website.

Support Policy

Only Users with an active Subscription/Lifetime license are eligible to receive customer support via email.

The User must use the same email address that he/she used for the purchase to request support so the Company can verify the License status. The Company shall make a reasonable effort to respond in a timely manner.

Payment

When purchasing any Plan, you are obliged to pay the fees for it at the intervals listed on the Website. All listed prices exclude taxes (VAT/GST). Sales tax is added on top of the price according to the country you are purchasing from.

All payments are processed through our third-party payment processor, Paddle.com. The Company does not store your credit card or PayPal details. Tax collection and remittance are handled by Paddle.com as well.

As long as a Subscription is active, it will be automatically renewed and billed in full upon the end of the billing period.

Cancellation

You can cancel your Subscription at any time from your Bricks account. The cancellation will take effect at the end of your current billing period. Until that date, your license remains active, and you will continue to receive software updates and technical support via email.

Once the cancellation becomes effective at the end of your billing period, your Subscription status changes to “canceled”, and you are no longer eligible for software updates or technical support from us.

Reinstating a canceled Subscription at this stage is no longer possible, and you’d have to purchase a new Subscription at the current price at this point in time.

You can revoke your Subscription cancellation request from your account at any time before it becomes effective.

You can continue to edit your sites with Bricks after the cancellation. But as you are no longer eligible for Software updates, please bear in mind that running outdated versions of any Software has an inherent security risk.

Change Subscription Plan

Upgrading or downgrading your active Subscription to a different plan is possible from your account.

After selecting the new plan, you’ll see an overview that lists all costs associated with this change.

You have to explicitly confirm this intended change to render it effective.

All plan changes are prorated. This means you are either charged a certain amount (when you upgrade) or will receive a credit (when you downgrade) for the remainder of your current billing period.

Your subscription bill date does not change when you move to a different Subscription plan.

Moving from a Subscription Plan to a Lifetime license is not possible.

Refund

We stand behind the quality of our Software. If, for any reason, you are not fully satisfied with your purchase, you are entitled to a full refund within the first 60 days after your Purchase. To request a refund for your purchase, please use the contact form on our Website and include your full name and order ID in your request.

Termination

The Company reserves the right in its sole discretion, and without prior notice, to change, modify, discontinue, or terminate access to the Software for any or no reason and has no liability to you, the User, or any third party in case such an action takes place.

Law And Jurisdiction

These terms will be governed by and construed in accordance with Cypriot law. Any disputes relating to them will be subject to the non-exclusive jurisdiction of the courts of Cyprus.
